Welcome to MyHeartfolio. These Terms of Service explain the rules for using our website and ordering a custom digital storybook gift from us.

By using our website, submitting an order, or purchasing a MyHeartfolio product, you agree to these Terms.

1. What MyHeartfolio Provides

MyHeartfolio creates personalized digital storybook experiences based on the information, photos, memories, messages, and creative direction provided by the customer.

Our products may include written story pages, visual scenes, edited or stylized images, animated elements, music, private digital links, and other digital creative components.

MyHeartfolio products are custom-made digital products. They are created specifically for each customer and are not physical goods.

2. Customer Responsibility

When placing an order, you are responsible for providing accurate and appropriate materials, including but not limited to names, photos, written memories, relationship details, messages, and creative preferences.

You confirm that:

• You own or have permission to use any photos, text, names, messages, or other materials you submit.
• Your submitted materials do not violate another person’s privacy, copyright, image rights, or personal rights.
• The information you provide is accurate enough for us to create the product.
• You understand that the final result depends heavily on the quality and completeness of the materials you provide.

We are not responsible for issues caused by incorrect, incomplete, unclear, low-quality, or unauthorized materials submitted by the customer.

3. Use of AI and Creative Tools

MyHeartfolio may use AI-assisted tools, creative software, editing tools, animation tools, image-generation tools, writing tools, and other third-party production services to create, edit, stylize, enhance, animate, or assemble parts of your digital product.

The specific tools we use may change over time depending on quality, availability, cost, reliability, and production needs.

By placing an order, you understand that AI-assisted tools may be used as part of the creative process.

If you choose an option where your photos must remain unmodified, we will make reasonable efforts to follow that instruction. However, some technical adjustments may still be necessary for formatting, sizing, cropping, compression, or display purposes.

4. Creative Interpretation

MyHeartfolio is a creative service. While we aim to follow your instructions and preferences, the final product will involve artistic interpretation.

Examples, previews, demos, and sample products shown on our website are for illustration only. Your final product may differ based on your submitted materials, selected package, chosen style, and production requirements.

We do not guarantee that the final product will match a customer’s exact emotional expectation, personal imagination, or subjective preference. However, we do include revision rounds according to the selected package.

5. Packages and Revisions

MyHeartfolio currently offers the following package revision allowances:

A revision round means one collected list of requested changes submitted by the customer after reviewing a draft, preview, or delivered version.

Included revisions may cover reasonable changes such as:

• Text edits
• Minor visual adjustments
• Small scene changes
• Corrections to details
• A full change of style or template
• Adjustments to tone, order, or presentation
• Replacing individual materials where technically possible

Included revisions do not cover:

• A completely new story concept after production has started
• Replacing most or all submitted materials
• Adding pages beyond the purchased package
• Requests that require rebuilding the product from scratch
• Changes that conflict with the original order instructions

Additional revisions may be available for an extra fee. Unused revisions have no cash value and are not refundable.

6. Content We May Refuse

We may refuse, cancel, or stop work on an order if the submitted content is inappropriate, illegal, harmful, abusive, hateful, exploitative, sexually explicit, threatening, defamatory, or violates another person’s rights.

We may also refuse content that includes private materials submitted without permission.

If we cancel an order for these reasons, refund eligibility will depend on the stage of production and the specific circumstances.

7. Payment

Prices are displayed before purchase or confirmed directly with the customer for custom orders.

Payment may be processed through third-party payment providers such as ‘PayPal’ and Payoneer. We do not directly store full payment card details.

An order may not begin until payment has been received or confirmed, unless we agree otherwise in writing.

8. Delivery

MyHeartfolio products are delivered digitally. Delivery may happen through a private web link, email, downloadable file, or another agreed digital method.

Estimated delivery times may vary depending on the package, complexity, customer response time, quality of submitted materials, and production workload.

The product is considered delivered once we send the digital product, private link, preview, or final file to the customer's email address.

Digital products delivered by private link may not be password-protected unless specifically stated. The customer understands that anyone with access to the link may be able to view the product.

9. Customer Delays

If we need additional information from you and you do not respond, the delivery timeline may be delayed.

If a customer becomes unresponsive for a long period, we may pause the order until the necessary information is provided.

10. Intellectual Property

MyHeartfolio retains ownership of its website, brand, templates, layouts, designs, systems, workflows, and original creative materials.

The customer retains ownership of the original materials they submit, such as their own photos and written memories.

After final delivery and full payment, the customer receives a personal-use license to view, share privately, and enjoy the final digital product.

Unless we agree otherwise in writing, MyHeartfolio products may not be resold, redistributed commercially, copied as a competing product, or used for commercial purposes.

11. Portfolio and Marketing Use

We will not publicly share your private story, photos, or final product for marketing without your permission.

If we would like to use part of your order as a public example, testimonial, case study, or portfolio sample, we will ask for consent first.

12. Privacy

Your use of MyHeartfolio is also covered by our Privacy Policy, which explains what personal information we collect, how we use it, and how we protect it.

13. Service Availability

We aim to keep our website and delivered digital links available, but we cannot guarantee uninterrupted access. Hosting providers, third-party services, technical issues, or maintenance may affect availability.

Where possible, we will try to fix access issues that affect delivered products.

14. Limitation of Liability

To the maximum extent allowed by law, MyHeartfolio is not responsible for indirect, incidental, emotional, special, or consequential damages related to the use of our website or products.

Our total liability for any order will not exceed the amount paid by the customer for that specific order.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a new effective date.
